ALLEGED ASSAULT
TWO MEN COMMITTED FOR TRIAL. The hearing was concluded in tho Magistrate’s Court yesterday, before Mr D. G. A. Cooper. S.M.. of the charge against Ernest John McEwen aud James David McEwen, of assaulting Walter Pierson Jackson, so as to cause him actual bodily harm. They were farther charged with robbing him of a watch and chain valued at .£1 7s, Accused, who were represented by .Mr J. F. W. Dickson, pleaded not guilty. Constable Sheehan, continuing hisevi. dence, said ho saw David McEwen out. side the Brunswick Hotel. He was by himself, and when witness spoke to him. the accused said he was waiting for an Aro street ear.
Ada Byrne, living in Holloway road, said that on the night of the 21st she heard moans and groans outside hei house, and on investigation found Jacksou with blood upon his face. Together with her husband she took him inside and bathed his face. When she was unable to stop the bleeding she suggested that Jackson get medical aid. Jackson then had a watch chain, on which there was blood. To Mi: Dickson; Her attention was first drawn by hearing a scream in a man’s voice. She also heard a woman’s voice. Sho did not know where the assault took place. It was quite true that Jackson, when he loft her place, had a watch chain m his possession. Mr Dickson submitted that the court should dismiss both informations. Tho
only evidence of value was Jacksons, which must be looked at very closely. There was an assault; there was no doubt that Jackson was dazed, and his evidence from that point must be accepted with reticence. Here was a man, in a dazed condition, swearing upon his oath as to the positive identification of two men whom he had never seen in his life before. After further evidence had been heard both accused were committed for trial in the Supreme Court upon the charge of assault. Bail was allowed m tho sum of .£SO. The Magistrate; remarked that he did not think a jury would convict on the charge of stealing the watch.
