FURTHER HEARING
Tho hearing was continued before tho Court ot Appeal yesterday of tho appeal brougat by uio Merchants’ Association ol New Zealand, tne Colonial Sugar Refining Co., Ltd., Levin and Co., Ltd., W. At. iiaimatyne and Co., Ltd., and Joseph Nathan and Co., against the decision ot ius Honor tho Cuiet Justice (Sir Robert Stout), whereby the appellants were convicted in tho court below of having committed breaches of tho Commercial Trusts Act, tyiO. On tho Bench were their jaouors Sir Joshua Williams, Air Justice Doumstoii, Air Justice Cooper, and Air Justice Chapman. Mr 0. R. fcikorreto, K.C., with him Air T. Young, appeared for tho Aierefiants’ ■ Association,; Bannatyno and Co., and Joseph Nathan and Co.; Mr j„ pi. Hcsking, JK...G., with .him Air H. P. Richmond, for the Colonial Sugai Co.; -Ur M. .Myers for Levin and Co.; tho Attorney-General (Hon. A. L. iiurdman), with him Sir John Findlay, X.C., and Air 11. L* Ostler, ter the Grown. , , , Air Richmond, who had commenced his address on the previous day, concluded, and was followed by Air Alyers, who explained tho difference between Levin and Co.’s position now and in tho Supremo Court before ono of tho charges was dismissed. His address had not concluded when tho court adjourned for tho day.
