In, the Supreme Court yesterday morn, ing, before Mr Justice; Cooper, the case of David Peat, farmer, of Hillside, Wanganui, v. Commissioner .of Stamps, was mentioned- by. counsel.'.Peat'(desired to dispose of a sum of .JSOOO ,in eighteen, separate gifts of .fiSOO. - These, gifts; the Commissioner of , Stamps : held, were really one single disposition, ana as such were liable to a tax of JMSO. At Wanganui Mr Justice Cooper was asked to set this -decision aside. His Honor dismissed Peat’s appeal, but did not decide whether there was one single disposition or eighteen separate gifts. An order for the payment by. Peat of a definite sum of j2*so/wais Sealed by the Crown Solicitor. ’ The 'appellant now moved to set this order . Aside'on th'a ground that it did'hot .express "the . intention of the court j that it made the judge apparently decide' the 'matter which lie ' did not decide, and which was not before the, court; and that the order as drawn was' one . which the court had no power whatsoever to make, because if a question of law were decided by the judge, tho assessment of duty had to be made , by the Commissioner.
