DR PEACOCK’S CASE A NEW TRIAL ORDERED. 87 Telegraph—Press Association—Copyright. (Received December S, 9.-10 p.m. SYDNEY, December 8. The Federal High Court quashed tho conviction of Dr Peacock for the murder of Mary Davids, who disappeared after going to him,for an illegal operation. The Chief Justice (Sir Samuel Griffiths) found that although there was sufficient circumstantial evidence to show that Mary Davies was dead, there was not sufficient to connect Dr Peacock with her death, there being no corroborative evidence of that of Poke, who was an accomplice. At the trial, the judge should have directed the jury that there was no corroboration of Poke’s evidence, and therefore that it was dangerous to convict. Had the judge done this, tho jury must have returned a verdict of not guilty. Therefore ho (the -Chief Justice) had not granted a new trial. Justice Barton agreed with quashing the conviction, but considered that there should be a new trial.

Justice O’Connor agreed that there should bo a now trial, and tbo court ordered accordingly. ,
