DAMAGED PIPES
DDE TO IMPROPER STOWAGE. Further evidence was heard before Sir Robert Stout, Chief Justice, and a jury of four, at the. Supreme Court yesterday, in the case of Duthio and Co. v. tho Now Zealand Shipping Company, Ltd*, a claim for J 3114 17s Id for damage to a shipment of pipes brought out in the Turakina for tho construction of tho Waiuui main. Plaintiffs were tho owners and consignees of 303 iron pipes shipped by tho Turakina at London in. April, 1911. A number had been, cracked or broken in transit. Defendants alleged that tho damage was caused by the fixture of a ring at tho end of each of .tho pipes, which were insufficiently packed, and that they were not responsible for damage to castings. Mr C- B. Morison appeared for plaintiffs, and Mr H. D, Bell. K.C., with him Mr G. lE. Foil, for tho defendants. The jury returned a verdict that the damage was due to improper stowage. Ills Honor reserved judgment pending the hearing of legal argument.
