AGGRIEVED MEMBER'S ACTION DEMURRER TO DEFENCE UPHELD By Telegraph—Press Association —Copyrl^ir. (Received November 17, 7.30 p.m.) SYDNEY, November 17. Tho Full Court upheld tho demurrer raised on behalf of the plaintiff in tho case brought by Mr .Tohn Perry, mem her of the Legislative Assembly for Richmond, against Speaker "Willis and tho Scrgcani>at-Arms for assault and wrongful imprisonment, arising out o> tho recent scenes in tho Assembly. The defendants pleaded not guilty, and also that any action taken was for tho purpose of preserving order and maintaining the standing orders. Tho plaintiff demurred to tho second plea, claiming that it disclosed no justification for his .being brought back to tho House in custody and detained. Tho court held that tho Speaker was merely acting as tho chairman of tho mooting, and had no positive power. Tho cause of disorder having been removed by plaintiff leaving the House, tho Speaker had no power to bring him back, an action which Mr Justice Pring characterised as an extraordinary deprivation of a, man’s liberty.
