BREACH OF CONTRACT. CLAIM AGAINST THE RUGBY UNION UPHELD. Dr. McArthur, S.M., delivered reserved judgment at the Magistrate’s Courtyesterday in the case in winch tho Petone Borough Council sued tho AVellmgtou Rugby Union for .£25 general damages alleged to have been sustained through defendants failing to comply with tho conditions of a contract entered into ietween tho parties to the action relative to the football matches to be played on tho Retono Recreation Grounds during tho season 1900. , “The breach complained of,* said has Worship, "was tho removal of a match, Petone v. Athletic, set down to bo played on August 7th on the Petone Recreation Ground, from that ground, to the Athletic Park. The defendants claim they had the right to do so under thecontraot, as it was a scini-final match, whereas tho Plaintiffs deny that it was a semi-final, and therefore ought to have been played as originally sec down, as the original list stood immediately before the matches of August Hh were plaved. the match Petone y. Athletic could not lie called a scim-final with matches to play on August 1™“ and 25th. ... In my opinion the match was not a semi-final in the truest sense of the word.” , . „ "As to the amount of the claim, . concluded his “X tln.uk it is a most reasonable one.” , , .Judgment was given for plamtins tor tho amount claimed with costs.
