PEESS ASSOCIATION. CHI? ISTCHUKOII, October 25. In the Supreme Court this morning Hr Justice Sim sentenced James Girdwood McKenzie, charged with theft of moneys from the State Fire Office. Sentence had. been deferred to allow the judge to look into the authorities on the question of probation. His Honor said that in the case of Hex v. Fcwler, Mr Justice Cooper had laid it down that the First Offenders’ Probation Act should be ad min isle lod on some settled principle. Where an offender abused his position of trust on more than one occasion probation could not be granted. In Eex v. Clark, quoted by counsel, Mr Justice Chapman had allowed ‘probation to a Read Board officer became, the thefts had been due i<* drink, and there had been no criminal intent. In the present case there was no circumstance of the kind. Prisoner was sentenced to six mouths* hard labour.
