c CASES IrT COURT FIRST CHARGE OF LAYING "TOTE" ODDS IN WELLINGTON. At the Magistrate's Court yesterday, before Mr W. G. Riddcll, S.M., four charges arising out of alleged street betting were called. William Ham was charged with being a bookmaker, and making a bet in Willis street on September 23rd. Samuel Isaacs was charged with (1) Being in Willis street on October lOtli. for the purpose of betting; (2) being ». bookmaker he did make a bet in Cuba, street on October 10th with Thomas Jones on the Now Zealand Cup at Christ, church; and (3) on October Ist he did make a bet with Thomas Jones upon th* result of a horse race, namely Dieadless,. in the Marangi Handicap, whereby ho. agreed to pay Thomas Jones, should the horse win, a sum of money upon the re** suit of the working of the totalisator, CkSef-Detective Broberg prosecuted, and Jii'* E. J. l'Htzgibbon appeared foB the accused. ■ ■ ADJOURNMENT GRANTED. When, the cases were called Mr Eitz.' gibbon stated that lie bad only been instructed tire day before, and be asked that the 'eases be adjourned for a* week. WHAT THE ACT PROVIDES. The third change preferred against the accused Isaacs, tiro first of its kind to 'be laid in Wellington, and probably in New Zealand—is under the authority of section 52 of the Gaming Act, IMS, which provides that: — "Any person who makes or enters into a bet upon the result of a horse race, whereby he agrees to pay tine other pairty to the said bet, if the latter should win the same, a sum of money the amount, of which is dependent the result of the working of the totalisator on the said horse race, and any person (not being a person lawinlly conducting, or employed in the working of a totalisufor) who sells or offers for sale, and any person who purchases from him, any tidret, card, or thing entitling or purporting to entitle the purchaser or holder thereof to anv interest in the result of the work-' ing of"the totalfeator on any horserace, or makes any contract or tea-gain of any kind to pay or re?-eive money upon on .event determined or to be determined by the ■ result of the working of tire totalisator or any horse rate, is guilty of an offence, and is liable on summary conviction to imprisonment with or 'without bard labour for a term .not exceeding three months, or' to a fine not exceeding ,£2O, or to both fine and imprisonment.
