MEETING OF CREDITORS

A 'meeting of creditors in the estate of James lies Clemens, of Petone, slaughterman, bankrupt, was held at the Official Assignee’s office, Brandon street, yesterday. The Official Assignee (Mr Ashcroft) presided. Mr Wilford appeared for the bankrupt, who was also present. The bankrupt’s statement showed debts owing to unsecured creditors amounting to £62 12s _Bd. There were no secured creditors, and the assets were nil. The principal creditors were; —H. Damaut. £2l 11s 9d ; G. Stutter, £lO 4s lOd; M. Wobley, £9 15s 6d; Dr Perry, £5; R. Corson, £3 11s; R. McWhirter, £2 5s sd; and J. Cotton, £2 (all of Petone); and St. C. Jounnax, £3 6s 2d (of Lower Hutt). . The bankrupt stated that owing to sickness in his family, and oeon out of work, he had got behind in his accounts. His earnings were not sufficient to enable him to more than pay his way. The furniture in the house belonged to his wife. He could not possibly make an offer. A creditor said the bankrupt had beenin constant work, and earning good wages. Mr Wilford said that if that were so representations should be made to the Judge of the Supreme Court, who would refuse discharge if he wore satisfied about the earnings. Mr Stutter said the Bankruptcy Act had never been intended to apply to a case like this. The bankrupt had purchased goods from him on the very day of filing. The Official Assignee said that if that had been done it would lay the way open for criminal proceedings. The bankrupt said the goods had been purchased by a member of his family without his knowledge. Mr Wilford pointed _ put that in that case there could be civil liability, but no criminal action. , .

It was decided to request the bankrupt to make out a statement of receipts and-expenditure for the past twelve months. The Assignee accordingly ordered him to do this-_ When ; the meeting concluded the creditors expressed the intention of appearing at Court when the bankrupt applied for his discharge. -
