Thursday. : The- Bank of New South: Wales lias .brought an action against his Excellency the Governor (Colonel Sir Ger.ard Smith) anti otuers in regard to a sum of £5700 advanced on. overdraft to the Australia Hotel, ijimited, Coolgardie. The deteudimts are sued: as guarantors. . > Tho defence is that the bank negli- ■ gently realised on its security. It is alleged that assets worth £15,000 were sold by the bank for £2OOO. : From evidence in the case.it appears that a letter written by the Governor < eulogising the undertaking was sent to England ,in order to assist the sale of the .company’s shares.
