THE BOOKMAKER'S CASE.
Judgment in the bookmaker’s case Pollock v. Saunders, which was a case brought by the Bookmakers’ Association against tha associated racing clubs to test the question as to whether bookmakers had the right to go onto a racecourse upon a ticket being issued to them, was given in the Appeal Court yesterday. The particular case was one between Mr J. H. Pollock and the Feildiug Jockey Club, the club having turned the appellant off its course, although he did not bet. Their Honors held that tha club was the owner of tho laud from which the plaintiff was ejected, and therefore had the right to exclude any person or class of persons. The plaintiff claimed that the club had, through using a licensed totalisator, forfeited the right to exclude him. The extreme paucity of cases hearing on the point seemed to show that interference with private property must only be allowed with groat care, if at all. The plaintiff’s reliance on tho use of the totalisator seemed extravagant, as the use of the totalisator did not limit tho clubs in excluding the public if necessary. Pollock belonged to an excluded class and was therefore as much a trespasser as if he had climbed over tho fence. _ There was no question of revocation of license, as he never had a license. Judgment was therefore given for tho defendant, with costs on the lowest scale.
