Messrs George and John Gordon Smith, of the Glenlivet Distillery, Glenlivet, beg to intimate that in connection with their registered trado mark * * Glenlivet,’’ perpetual injunctions were this day granted by the High Court of Justice in England against the defendants, Alexander Fraaor and Co., of the Glenburgie Distillery, in the County of Elgip, and Charles Robert Haig, of Mark Lane, in the City of London, restraining them from infringing such mark. Below will be found copies of the orders made by Mr Justice Olitty in these actions. Messrs G. and J. 3. Smith take this opportunity of stating that they will continue to take every means to prevent any whiskey but their own manufacture being sold to the public aa “ Glenlivet.” “Smith v. Fraser and Co. (1882. S. 6291.) — Let, by consent, a Perpetual Injunction be awarded to restrain the defendant, his servants, and agents from advertising, publishing, or in any way representing that the whiskey the defendant makes, or disti’s, is ‘ Glenlivet,’ or from selling, or offering for sale, any whiskey made by him as ‘ Glenlivet,’ or from in any way using, or permitting to be used, the term Glenlivet ’ in connection with whiskey made by him, and from in any way infringing the plaintiff's registered trade mark ‘ Glenlivet.’ ” “ Smith v. Haig, (1882.
