RESIDENT MAGISTRATE’S COURT.

Tuesday, January 14. (Before T. A. Hansford, Esq., E.M.) WIFE DESERTION. Edward Doer was summoned by his wife, Margaret Doer, for deserting her on 25th November. The case was adjourned for fourteen days for the production of further evidence. LUNACY. James Lawrie was charged, on remand, with being of unsound mind. Sergeant-Major Bevau stated that the prisoner had now recovered, and he was accordingly discharged. OBSCENE LANGUAGE. W. J. Johnston was charged, on the information of George Pound, with using obscene language towards him on the Bth inst. Mr. Connolly appeared for the plaintiff, and Mr. Fitzherbert for tho defendant, who was fined 20s. and costs, or seven days’ imprisonment. DESERTION. Michael McCarthy, an articled seaman on board the ship St. Leonards, was charged by Captain Todd with deserting from the ship on the 13th instant. Prisoner, who is sailmaker, stated that he only went as far as the post office to post a letter. The case was clearly proved, and prisoner was sentenced to fourteen days’ imprisonment. DAMAGING PROPERTY. J. W. Nicholson was charged by J. W. Kemball with wilfully breaking a window. Complainant stated that on the 3rd January prisoner knocked in the window with a hatchet. The case was a trumpery one. Defendant was fined Is. and costs, and ordered to make good the damage or to be imprisoned for three days. bacon’s cash. The lad Walter William Bacon was charged on remand with stealing the sum of £265 from the office of the Anchor Line of Steamers. On the application of the police the case was remanded until Friday, as the prosecutor was absent at Nelson. BREAKING WINDOWS. Alexander Livingston was charged by his brother, John Livingston, with breaking a window of the value of Is. Mr. Ollivier appeared for the plaintiff, and Mr. Fitzherbert for the defendant. Prisoner was fined Is. and costs, and ordered to pay 25., the amount of the damage, or three days’ imprisonment. CIVIL CASES. James Wylies v. H. H. Simmons.—Claim for £5 15s. The plaintiff in this action was machinist at the Theatre Boyal. Defendant admitted owing £5 ns a week’s salary, but stated that ha had lost over £350 during the last seven weeks at the Theatre Royal. On Monday he called all those who were due salaries, and told them there was no money. He had parted with all his jewellery in order to make things square. Judgment was given to the plaintiff for £6. J. Griffin v. Same.—Claim £3. Judgment for plaintiff for the amount claimed and costs.
