And I do hereby direct that, except in so far as is expressly provided for in the said Deed of Consent of the twenty-third day of March, 1876, the provisions of the said Act are to be deemed to apply to any purchase of the Tramway which may be made by the Mayor, Councillors, and Citizens of the said City of Wellington. And I do hereby direct that the consent of the Mayor, Councillors, and Citizens of the City of Wellington, to be signified by a special resolution in that behalf of the Council of the said Corporation, shall be necessary to any sale, assignment, or other disposition of the undertaking by the Promoters. And I do hereby direct that nothing contained in this order shall prevent the Council of the said Corporation from making from time to time the regulations which the local authority is empowered to make by Section 47 \ of the said Act. 1 And I do hereby direct that the promoters shall within fourteen days after the expiration of each year, computed from the completion of the Tramway, deliver to the Council of the said Corporation a true and complete return in writing of all traffic, and of the receipts and expenditure in connection with the same during the year then preceding, and that the said Council may, if they think fit, but shall not be bound to, publish the same for general information. And I do hereby direct that in case the Promoters shall at any time hereafter fail or neglect to observe, perform, fulfil, and keep all and singular the requirements, conditions, and provisions of the Tramways Act, 1872, or any other Act for the time being in force relating to tramways, and of this order to the full intent of the same ; or to observe any by-laws, rules, or regulations which may from time to time be made and passed under the provisions of the Tramways Act, 1872, or any other Act for the time being in force relating to tramways, then it shall he lawful for the Governor by Order in Council to revoke and annul this order and all the rights, powers, and privileges , hereby granted. And lastly, I do hereby order and declare that nothing herein contained shall be deemed in any way to interfere with, affect, or abridge any rights or powers that may be vested in her Majesty the Queen, or in the Governor on her behalf, or otherwise, under any Acts of the General Assembly authorising the construction of railways or tramways or the erection or construction of any other public work which her said Majesty or the Governor on her behalf or otherwise may be authorised to erect or construct. Nor shall her Majesty or the Governor or any person on her or his behalf be liable to pay to the Promoters any compensation for injury done to the tramway by the construction of any such railway or tramway or other public work as aforesaid, or for the loss of traffic occasioned thereby, or for the exercise of any such right or power as aforesaid. (Signed) WILLIAM FITZHERBERT, Superintendent. June 29th, 1876. SCHEDULE. Schedule of Tolls and Rates of Charge with Regulations referred to in the above Order. Passengers. 1. The maximum rates of charge to be made by the owners of the tramway for the conveyance of passengers thereon, including the tolls for the use of the tramway and of, carriages, and cost of moving power, and of every other expense connected with such conveyance, shall be: — For every passenger conveyed the sum of Threepence. 2. The foregoing charge shall not extend to any special trains that may be required to run on the tramway, but shall apply only to the ordinary trains appointed from time to time for the conveyance of passengers on the tramway. 3. Every passenger travelling on the tramway may take with him his ordinary luggage, not exceeding twenty-five pounds in weight, without any charge being made for the carriage thereof. Goods. 4. Subject to the provisions hereinafter contained respecting small parcels and single articles of great weight, the tolls to be taken by the owners of the tramway in respect of the tonnage of all articles conveyed in carriages thereon,, or on any part thereof, shall be at the rate of One shilling and Threepence per mile. Animals. 5. The tolls to be taken by the owners of the tramway in respect of animals conveyed in carriages on the tramway shall be: — For every horse, mule, ass, or other beast of draught or burden, ox, bull, cow, or head of neat cattle, conveyed in or upon. any such carriage, Two shillings. For every calf, pig, sheep, lamb, er other small animal conveyed in or upon any such carriage, Threepence. Provided always that it shall be lawful for the owners of the tramway to demand and take, in addition to the tolls and rates of charge hereinbefore authorised, a reasonable sum for the delivery and collection of goods and other services incidental to the business of a carrier where such services respectively shall be performed by the owners of the tramway otherwise than on the premises of the tramway. The following provisions and regulations shall be applicable to the calculation of the tolls: For a fraction of a ton the company may demand a toll according to the number of quarters of a ton in the fraction, and if there be a fraction of a ton, the fraction shall be deemed a quarter of a ton. With respect to all things except stone and timber the weight shall be determined according to the usual avoirdupois weight. With respect to stone and timber, fourteen cubic feet of stone and five hundred feet superficial feet of timber shall be deemed one ton weight, and so on in proportion for any smaller quantity. 8. With respect to small parcels and single articles of great weight, the owners of the tramway may lawfully demand for the carriage thereof the tolls following:— Small Parcels. For any parcel exceeding sevdn pounds in weight, and not exceeding fourteen pounds in weight, Fourpence. For any parcel exceeding fourteen pounds in weight, and not exceeding twentyeight pounds in weight, Sixpence. For every parcel exceeding twenty-eight pounds in weight, but not exceeding fifty-six pounds in weight, Eightpence. For parcels exceeding fifty-six pounds in weight, but not exceeding five hundred pounds in weight, such reasonable sum as the owners of the tramway may think fit. Such charges to include charge for delivery at the stations to the parties entitled to receive parcels so carried. Provided always that articles sent in large aggregate quantities, although made up of separate parcels, such as,bags of sugar, coffee, meal, and the like, shall not be deemed small parcels, hut that term shall apply only to single parcels in separate packages. Single articles of great weight, for the carriage of any one boiler or cylinder, or any one piece of machinery, or single piece of timber or stone, or other single article, the weight of which, including the carriage, shall exceed
