RESIDENT MAGISTRATE’S COURT.
Monday, July 27. (Before J. C. Crawford, Esq., R.M.) Breach of the Toll-Gate Act. —Joseph Stancliffe was charged with this offence, by refusing to pay toll at the Lower Hutt tollgate. Mr. Hart appeared for the defence. This case was one involving the long-argued point as to whether a vehicle carrying Her Majesty’s mails should he charged toll. His Worship dismissed the case with costs, on the ground that the defendant was in the service of Her Majesty at the time of passing through the toll-gate. The Act, as well as making such exceptions as are provided for by an Act of the Imperial Legislature, exempts any vehicles or animals belonging at the time to Her Majesty, her heirs, or successors, or employed in her, or their, service. CIVIL CASES. Regina v. Anders Anderson. —£19, passage money as an immigrant. Ordered to pay £1 per month. Same v. W. Burton.—£l2. Judgment for £1 per mouth. Styles v. Eountaiu. —£20 18s. lid. Order for amount and 19s. costs. Dooley v. Murdock. —£5. In this case the plaintiff sued for work and labor iu the erection of a chimney, and defendant put in a set-off for value of the bricks, labor iu pulling down the chimney, and delay, &0., as the work was not done in a proper manner. Judgment for defendant for £2, with costs.
