A CASE BEFORE THE ENGLISH

APPEAL COURT.

LONDON, February 24. The Court of Appeal lias refused to interfere with an order made by Mr Justice Bruce for a commission to take •evidence in New Zealand regarding the •Loss of the Ariadne.

Tho yacht Ariadne was wrecked near the mouth of the Waitaki river in April, 1901, while on a voyage from Sydney to Dunedin. The vessel was owned by one Thomas Caradoc Kerry, who, with Eric J. H. Frcke and George Mumford (the master of the' vessel), were -tried at tho Supreme Court at Christchurch on a charge cf conspiracy and casting the ship away. The case against Frcke •wa.s withdrawn. Kerry was found not •guilty. Mumford was sentenced to a term of imprisonment. Kerry was not on board at tho time of the wreck. B.e came over to New Zealand by the Tahmo from Sydney, where he was living 'at the time. The Court proceedings in connection with the affair were some-' ■what involved, one case arising out of the wreck being beard in Sydney. The Ariadne was alleged to have been insured far above her value, and it was further stated that she had been stripped of valuables prior to leaving Sydney. The case now disposed of by the Appeal Court in England most likely arises out of proceedings to recover the insurance. This claim is’probably ber)ng resisted.
