MAGISTRATE’S COURT.

At the Magistrate’s Court last week, before Mr Martin, S.M., a man named Donald Campbell, charged with drunkenness, was remanded until this morning, as he said he had taken out his passage for England by the s.s. Gothic. A coloured woman named Annette Harris, charged with vagrancy, was sentenced to three months’ hard labour, and Elizabeth Scott, similarly charged, was remanded for enquiries. Barton, claim £26 5s for board and lodging incurred by defendant’s employee, judgment was given for plaintiff for £5 12s 6d, with £1 16s costs. Mr Menteath for plaintiff, Mr Chapman for defendant. Wellington and Manawatu Railway Company v. W. R. Franklin,.claim £ls for use and occupation of land at Otaki. Judgment for plaintiffs, for whom Mr Travers appeared, for £5, with £1 14s costs. Messrs M. Kennedy, J. Jack and> E. Fraser Jones, Justices, occupied the Bench at Friday’s sitting of the Magistrate’s Court. Four drunkards were convicted and discharged. The other business before

the Court consisted of a number of charges against neighbours residing in King street Annie McFadden, charged with using indecent language to Susan Skinner, was ordered to be imprisoned until the rising of the Court. Sarah Gallichan was convicted of using insulting language to hlellie Hansen, and was bound over to keep the peace for six months in a personal bond of £5 and one surety of a similar amount. On a, charge of using abusive language to Kellie Hansen she was ordered to pay costs. Charges against Isaiah Fake of using obscene language and assaulting Neil and Annie McFadden were dismissed.

The, hearing of the civil case of Maslem v. Emeny, a claim for £35 arising out of a contract for building some shops in Cuba street, was concluded before Mr Martin, S.M., on Monday morning. Judgment was given for the plaintiff for an amount paid into Court, 4s 3d, and each party was ordered to pay his own costs. Mr Poynton appeared for the plaintiff, and Mr J. P. Three first offending drunkards were fined 5s each by Mr Martin, S.M., at the Magistrate’s Court on Monday, and Mabel Boalsted, a second offender, was fined 10s, with the usual alternative. Elizabeth Begarie, charged with vagrancy, was convicted and discharged on her promising to go to the Salvation Army Home, and Doris Wiley, similarly charged, was remanded till Wednesday for enquiries. Nicholas Fitzgerald, charged with the theft of a clock from the Junior Club, was remanded until Friday, bail being fixed at two sureties of £lO each.

Mr Martin, S.M., presided at Tuesday’s sitting of the Magistrate’s Court. A charge against John Lane of having failed to furnish a return of his income was adjourned until January Bth next. Alfred, Charles and Arthur Henderson were summoned by their father to contribute towards his support. The case was partly heard, and adjourned until Thursday. Robert Aitken applied for the cancellation of a maintenance order which had been made against him. The application was refused. Nicholas Fernandos, fishmonger, Lambton quay, for whom Mr Wilford appeared, was fined 40s, with 13s costs, for being in possession of a codfish under Boz in weight. .His Worship pointed out that the penalty under the Act was £SO. Ona first offending drunkard was punished in the usual manner.

In the Magistrate’s Court on Tuesday a woman named Mary Richardson was charged on a summons with having kept a brothel in Martin square. Mr Wilford appeared for the accused, who pleaded not guilty. Mr Martin, S.M., said he must dismiss the case, as he was unable under the circumstances to define the meaning of the word “ brothel.” •' In the Indictable Offences Summary Jurisdiction Act, under the heading of assaults/ there was _ a definition of the term, although the word was not mentioned in the interpretation clause. That being so, he must leave it to the Inspector of Police to indict the accused under the Criminal Code Act for keeping a disorderly house. Auckland, December 18.

McLean Black, said to be an ex-commer-cial traveller, has been sentenced to one month’s imprisonment with hard labour for the larceny of a book from the Free Library. .
