SUPREME COURT.

His Honor Mr Justice Richmond gave judgment on Friday for the defendant in the case of Chapman and Smith v. Mrs Hebbend. This case was heard on the Bth inst., when Mr Sinclair appeared for the plaintiffs and Mr Poynton for tho defendant. The action was one for specific performance of a contract to let a house and shop located at Thorndon. Tho defence was that there had been a misrepresentation of facts, and concealment as to who the intending tenant was, and that the agreement sued upon was void under the Statute of Frauds Act, inasmuch as it did not disclose the name of the tenant, nor could it be gathered from the contents who the tenant was. Smith, who had been acting for Miss Chapman and Mrs Hebbend in the matter, was, at the hearing, joined a 3 plaintiff witli Miss Chapman. Judgment went for the defendant on both the grounds stated, costs being allowed on the lowest scale.
