SUPREME COURT.
Mr Justice Edwards sat at the Supreme Court in Banco Wednesday, and gave judgment in the case of -Stains v. The Wellington City Council. In this case, argument in which was reported in our columns last week, His Honor now delivered, judgment, holding that the words “ not sooner than four weeks hereafter,” contained in section 121 of the Municipal Corporations Act, 1886, mad be read as equivalent to “ at an interval of not less than four weeks,” and that therefore the special order of the City Council, adopting certain provisions of the Rating Act, 1882, was not dnly made, there not having teen a clear interval of 28 days between the passing of the resolution and its confirmation. The appeal was therefore allowed, with coats £7 7s- Mr Martin, _ for the Corporation, asked for and obtained leave to appeal, Mr Skerretfe making no objection. This was all the business. (PER PRESS ASSOCIATION.) Christchurch, April 22. An interesting case was decided in the Supietne Court to-day, before Mr Justice Dennisfeon and a special jury of 12. A young man named Augustus Chipper sued Dr Mickle for £IGOO damages for alleged unskilful treatment in September, 1888. He accidentally inflicted a small cat near his knee and went to Dr Mickle, who attended him, and afterwards sent him to the Hospital. Hia leg got so bad that it had to be amputated. Chipper’s case was completely broken down by the evidence for the defence, which showed that he walked with his injured leg instead of resting it, and that in the Hospital he continually removed the dressings and drainage tubes despite repeated warnings from the dresser and nurses. Several doctors declared that this would account for the non-improvement in his condition, and the jury, after five minutes’ retirement, returned a verdict for th 6 defendant.
