(PER PRESS ASSOCIATION.) Christchurch, March 4. At the Resident Magf.t-ate’s Court today, Colonel Gayoor sued the Union Steam Ship Company for £2O. Mr Stringer for the plaintiff and Mr Nalder for the Company. The plaintiff alleged that on February 24. he took a saloon ticket at the Company’s office at Lyttelton by the Hanroto from I.yt. telton to Sydney, for which he paid £4. Subsequently he was informed she was a full ship and he could not be accommodated, and had to bring his luggage on shore. By missing the Bauroto he was prevented joining the connecting boat at Sydney, by which ho could frr the reduced fare of £1 have proceeded to HoHart, his final destination. He had aho to incur other hotel expanses during his nine days’ detention, and he would now have -to pay £9 passage money by the first available steamer. He therefore claimed £2O damages. The defence was that the ticket was issued to Colonel Gavnor subject, as he wasspecially informed, to there being no unoccupied berth. As soon as the list of berths engaged reached Lyttelton, it was found there were none unoccnpied. The Com. pany’s agent offered to provide the plaintiff with sleeping accommodation on the ship’s transom, with a reversion of any berth that might become vacant by its occupant leaving at a wav port, or the money would be returned. Both offers were refused, and the defendants now paid into Court the amntint of the passage moaey, though it was held that they could have legally retained it. Thoy also alleged that the plaintiff might, if he chose, have secured for the a birth on the Jnbilee, which left for Sydney the same night. Judgment was given for the Company, each party to pay its own costs.
