A BILL OF SALE CASE.
(PER PRESS ASSOCIATION.) Oamartj, Julj 23. A rather important case- to holders of bills of sale was tried before Mr District-Judge Ward to-day. Some time ago a bill of Bale was given by G. T. Waters over the furniture and effects in the Queen’s Hotel to the Commercial Property and Finance Company for £l3Bl, tho amount being made up of £459 owing by the previous occupier of the hotel and £922, the amount pf a bill of sale held by Thomas Low. Low filed his schedule, and the National Bank became the possessor of his bill of sale. The Commercial Property Company then purchased the Bank’s interest in the bill of sale for £155, and thereafter took a bill of sale from Waters for £l3Bl. Waters a short time ago filed his schedule, and the creditors took _steps to upset the bill of sale. The goods in the hotel had been variously valued, the valuations ranging from £I4OO down to £SOO. The plea of the plaintiff is that as the amount of the bill of sale was not a true statemeiß of the value of the goods as set out in the Chatties Securities Act, the bill of sale was invalid, and on this ground Judge Ward decided it to be void.
