COURT OF APPEAL.
Thursday, November 25. (Before their Honors the Chief J ustice and Mr Justice Richmond.) RICHARDSON V. JOHNSON. The application for costs in this case waa withdrawn, the matter having been settled. Mr Chapman appeared for the plaintiff, and Mr Gully for the defendant. OTAGO HARBOR BOARD Y. WILLIAMSON. Judgment was delivered, overruling the judgment of the magistrate, and allowing the appeal with costs. This concluded the business of the Court. IN BANCO. (Before their Honors the Chief Justice and Mr Justice Richmond.) OLLIYIKR V. COLONIAL BANK. His Honor Mr Justice Richmond delivered a written judgment in this case in favor of the plaintiff. SCHROEDER V. HARCOUPT. The judgment of the Court was delivered reducing the damages from £IOO to £lO, and allowing costs to the plaintiff. POWELL V. HARCOURT. Mr Justice Richmond delivered judgment, holding that a non-suit was not a bar to a second action for the same cause, and giving judgment for the plaintiff for £l7B. SMITH V. TAYLOR. This was an appeal against a conviction by justices in Wellington. The defendant was fined 10s for laying poison within three chains of a public road. The evidence set out in the case did not show that the land belonged to the defendant, or that he had laid the poison. Mr Jellicoe, for the appellant. The respondent was unrepresented. The Court quashed the conviction, bolding that there was no evidence whatever to justify the inference that the defendant laid the poison. Mr Jellicoe applied for costs, which were refused, as the informant had not appeared to support the conviction.
