A CURIOUS POINT.
(UNITED PRESS ASSOCIATION.) Kaikoura, May 26. A strange point was raised by Mr McLean in a rabbit nuisance case. For the defence he urged that clause 17 of the Larceny Act, No. 2, making it au offence to kill rabbits, was a sufficient reason to refrain from destroying them, although the Rabbit Act makes it penal not to kill, the one Act clashing with the other. [We fear that this ingenious point will not avail much. The following is the clause of the Larceny Act, No. 2, referred to : “ Whosoever Bhall unlawfully and willfully take or kill auy hare or rabbit in any warren or ground lawfully used for the breeding or keeping of hares or rabbits, whether the same be enclosed or not, shall on conviction thereof before a Justice of the Peace forfeit and pay such sum of money not exceeding ten pounds as to the Justice shall seem meet.”—Ed.
