McNAMARA v. NORWICH UNION.

(rER PRESS AGENCY.) Nelson, April 19. In the Supreme Court, before the Chief Justice, the case of McNamara v. Norwich Union Company occupied two and a half days. After the jury had retired for two hours and a half this afternoon they returned to Court and asked that they might be supplied with refreshments, which the Judge allowed ; and as this appeared to indicate further delay, the Court was again adjourned. Sunday. In the Supreme Court, before the Chief Justice, in McNamara v. the Norwich Union Company, for £6OO, amount of insurance, after an absence of six hours, the jury returned with the following findings on the principal issues :1. That plaintiff truly described to defendants the heat-producing apparatus used on the premises, so that the risk might bo justly estimated. 2. That the plaintiff fraudulently misrepresented the value of the property to be insured so far as the stock-in-trade, furniture, and wearing apparel were concerned, but not of the dwelling. 3. That the claim made by the plaintiff after the fire was fraudulent. 4. That the plaintiff is eutitled to recover £l4O. His Honor ordered judgment to be entered for plaintiff for that amount. Mr. Fell, for defendants, will move to set aside the judgment, on the grouud that fraud having been proved with reference to part, vitiates the whole contract. The case lasted three long days, and excited considerable interest.
