Tuesday, August 17, 1841. Before Captain Symonds and John Johnson, Esq. Captain M’Donald was charged by Mr. J. J. Montefiore, as agent for Mr. David Scott, with taking the schooner Harriett to Wangari, contrary to written orders, detaining the vessel there for seven weeks, and appropriating the stores to his own use while lying there. Mr. Whitaker, who appeared for the prisoner, said, previous to entering into the case, he should wish to know what was the specific charge against the prisoner. Captain Symonds informed him that, he believed, there was a variety of charges, but that he should confine the case to the prisoner’s detaining the vessel at Wangari, and then deserting her* Mr. John Wilson was then called, and proved having chartered the Harriett from Captain Donald, for £25, from the Bay of Islands to Auckland, and to touch at Wangari. After remaining some days at Wangari, witness requested M’Donald to proceed, but he refused to do 80. Afteralengthened investigation, which occupied the Court upwards of two hours— Captain Symonds committed the prisoner to take his trial at the Quarter Sessions, for illegally detaining the vessel at Wangari, and making aw»y with the ship’s stores.
