FAULTY PRESCRIPTION COMMENT BY MAGISTRATE (0.C.) NAPIER, Thursday The withdrawal of four charges and a change of plea to guilty on the remaining charge provided a surprise development in the Magistrate's Court .today when the case in which Dr James Allan Horry was charged'on five counts with breaches of the Dangerous Drugs and Poisons (General) Regulations was resinned. Mr J. Miller. S.M., imposed the minimum penalty, £l2 10s, with costs, JCU 14s 7d. He also made an order that particulars of the conviction be sent to the registrar oi medical prnctitiomTS, as provided under the regulations.

The magistrate said that on May S last ii patient from Auckland temporarily residing in Havelock North called on Horry for treatment. Toward the end of the interview he asked for a prescription and Herrv handed hi in a prescription. Arising out of this one transaction five informations were laid against Horry. The offences consisted of failing,to write on the proscription the addresses of the doctor and the patient, one drug being written in cipher, and failure to state the amount of one of the poisons and details as to doses. It was on this last count that the plea of guilty was entered. Defence Remarks Unjustified

Certain words used by the defence, said Mr Miller, were without justification or foundation. The chemist to whom the prescription was handed was described as a "pimp" and the methods of the department those of the Gestapo. "The chemist did not inform upon Horry," said Mr Miller. He sold only one of the two drugs mentioned in the prescription. In forwarding his voucher for payment- to the (lepartmi lit he was hound' to attach the proscription in supporting his claim. He simply noted the fact that lie was claiming payment for only one of the drugs. "As far as the department is concerned. one had only to listen to the evidence of Dr McLean, an officer of the department, to form an opinion from his fairness and patience. There is not a trace of Gestapo methods. Prescriptions on Used Envelopes

"Herrv has needlessly brought about these prosecutions," said Mr Miller. "It is simply a case ol Horry tailing to write in an ordinary proscription the full details required by the regulation to trace and check drugs and poisons covered by the regulations." It was claimed that the regulations were irksome, continued the magistrate. It: was surely not irksome simply to supply the addresses of the persons concerned, to name the drug or poison and the quantity and dose. Instead of using ordinary prescription forms, Berry wrote on used envelopes. Two other prescriptions for other patients were produced and these were written 011 the blue mottled sides of used envelopes and in consequence wore for the most part illegible. "These appear to be petty, irritating tnrtics unworthy of n medical practitioner of Berry's high standing and reputation," concluded the magistrate.

DAMAGES CLAIM FAILS JUDGMENT FOR VENDOR Judgment for the defendant was given by Mr J. Morling, R.M., yesterday in an action for £'.' 100 damages brought bv Mrs Violet Myra Delamore (Mr G. H. Turner) against Mrs Margaret Emma Tilby (Mr C'leal). following the sale of a fruit and vegetable business in Ponsonby Road on June 4. In her claim plaintiff alleged that she had been induced to buy for C'KOO a business not worth more than .£SOO. The magistrate said the books showed that the turnover was steadily increasing during Mrs Tilhy's ownership of the business. A drop in the takings when Mr Delamore took over did not indicate that the defendant had been buying quota linos on the black market. It was a well-stocked shop and the magistrate said ho was completely satisfied there was no evidence of black marketing. Both Mrs Delamore and her husband had had an opportunity of examining the stock before they bought the business.

"I am satisfied that defendant's representations were made honestly." concluded the magistrate in giving a decision in her favour, with costs.
