CHARGE DISMISSED
BIGAMY ALLEGED A bootmaker, Cyril Southwood (Mr. Sullivan), appeared before Mr. J. Morling, S.M., on a charge that, having been married in Portsmouth, England, in October, 1920, lie went through a form of marriage in Auckland in 1935, thereby committing bigamy. A plea of not guilty was entered. Detective Finlay, of Whangarei, said that in a statement accused said he had tried to locate his wife with the help of the English police, but had failed. He did not hear from his wife again until 15 months after he went through the form of marriage in Auckland. Counsel said the Crown had failed to prove that during the seven years prior to his marriage in 1935 accused knew his wife was alive, and the charge therefore must fail. Detective-Sergeant Nalder said accused must have had a guilty mind to call himself by another name in the Auckland marriage notice and to describe himself as a bachelor. "I have come to the conclusion that a jury would be unlikely to convict," said the magistrate. The charge was dismissed.
