Some who may be in demand are Radiant Bay, Hessketoon and Bisquit INTERESTING RULING 'APPEAL UPHELD BY COURT According to a ruling by a South African Judge, Mr. Justice Carlisle, it seems that there will need to be a revision of the racing rules in that country. A jockey named Roy Marlin was warned off for six months after having ridden Dark Renown at Durban on December , 7. but his appeal to the Supreme Court last month was' upheld. Marlin, in his grounds of appeal, took the point that the constitution of the Durban Turf Club committee was irregular; the principles of justice were not observed, and that the inquiry was null and void because one of the stewards at the inquiry Mr W Jackson was at' the. same time witness and judge. Giving judgment, Mr Justice Carlisle quoted a statement made by Mr. Jackson, who was at the start of the race, which was; "I 1 was at the start, and i wish to say that this horse had every chance of getting away, bnt the jockey never tried at all. and he almost pulled the horse's head off It was one of the most deliberate and undoubtedly one of the worst cases I have seen within the last '2O years." Mr. Justice Carlisle said that the conclusion he had come to was that there was no provision in the rules providing expressly that a steward might be both witness 'and judge at an inquiry. Having regard to the emphatic statements made by Mr Jackson, he was satisfied that a reasonable man must_ entertain suspicion that Mr. Jackson was biased.
