CLAIMS BY ESTATES

APPEAL COURT HEARING [by telegraph—PßESS association] WELLINGTON, Wednesday The Court of Appeal to-day heard an appeal from the judgment of Mr. Justice Ostler delivered at Auckland on September 6,. 1939, in an action by James Macßae, of Tirau, as executor of the estate of George Macßae, of Tauranga, retired farmer, deceased, against William Thirkell, of Tauranga, as executor of the estate of- Marion Wilson Macßae, deceased, wife of George Macßae, deceased. The action was one involving accounts between these two estates.

The plaintiff estate claimed £250 as money owing to it by the defendant estate and the defendant estate in turn counter-claimed for £3OO alleged to be owing to it.

Mr. Justice Ostler found in favour of the plaintiff estate and gave judgment for £250. The counter-claim was dismissed. From this decision the defendant estate to-day appealed. Decision was reserved.
