THIRD COUNTER-CLAIM ANOTHER NONSUIT GRANTED [by TELEGRArH —PRESS ASSOCIATION"] WELLINGTON. Monday In the Supreme Court Mr. Justice Smith to-day granted a nonsuit iu the third counter-claim in a series of cases brought by Double Grip Tubular Steel Devices, Limited, proprietor of the exhibition playland, against stallholders for possession of amusement stands and arrears of rent. Sidney Herbert Newcombe claimed £SOO damages for alleged fraudulent misrepresentation by Henry Seff, the company's representative, but His Honor, in a written judgment, held that no case had been made out. After an adjournment to enable the parties to discuss a further counterclaim by E. Jasper and G. McKenzie, stallholders, counsel for the company said a settlement had been arranged and the counter-claim withdrawn on the stallholders' undertaking to relinquish possession of the stall forthwith. The claim proper was adjourned sine die subject to 48 hours' notice by either side. Counsel for defendants said there would be 110 more cases for the present sitting of the Court.
