JURY DISAGREES
.MOTOR FATALITY SEQUEL COURT ORDERS NEW TRIAL [from our own correspondent] HAMILTON. Friday After a retirement of over four hours, the jury failed to agree in the case heard before Mr. Justice Heed in the Supreme Court at Hamilton in which Harold Leonard Morgan, aged ,28, insurance agent, of Waihi, was charged with negligent driving and causing the death of Dudley Raymond Hughes, aged eight, years. The child was a passenger in ' a car driven by his father. The car crashed into a poMer pole and the child received fatal injuries. It was alleged that the accident was caused by accused's negligence. in touching Hughes' car when overtaking it. Accused denied the charge and said he passed Hughes' car two miles from the scene of the accident, and did not touch it.
Mr. J. 11. Fitz-Gerald appeared for the Crown and Mr. T. Henry for the accused. A new trial was ordered for next sessions.
