SECOND TIME IN SAME' CASE JUDGE ORDERS THIRD TRIAL [BY TELEGRAPH —PRESS ASSOCIATION] DUXEDIX, Tuesday The retrial of George Albert Terry on a charge of negligently driving, a ear and causing the death of Douglas Haig Gutsell was held in the Supreme Court yesterday. When the case was first heard on February 7 the jury was unable to reach an agreement and the Chief Justice, Sir .Michael Myers, discharged the jurj r and ordered a new trial.

A repetition of the evidence given in the. first hearing was heard to-day. Evidence foir the defence was given by accused. ' , After a retirement of five and a-half hours the jury reported that it was unable to agree on a verdict. Mr. Adams moved lor a new trial, which His Honor ordered for the next session of the Supreme Court. Bail was allowed as formerly.
