TROUT PROSECUTION

THREE MAORIS IN COURT FINE FOR "TAKING AND KILLING" [by telegraph OWN correspondent] ROTORUA, Thursday On charges of taking and killing trout from a stream near Broadlands, three Maoris were to-day each fined £5 by Mr. S. L. Paterson, S.M., in tho llotorua Police Court. In their defence tho accused admitted that they had been attempting to catch trout, but stated that actually they had not secured any. Their courisel, Mr. W. 11. P. Moody, - submitting that this did not constitute an offence of taking and killing trout. Tho conservator of fish and game, Mr. A. Kean, who prosecuted, pointed out that under the Fisheries Act the interpretation of taking and killing included attempting and pursuing. The conservator's submission was upheld by tlio magistrate.
