CLAIM ITOE WAGES DISPUTE OVER POSITION CASE FOR THE PLAINTIFF A claim for payment of his services, allegedly as farm manager over a period of years, was brought hy Hugh lhomas Smith, of Auckland, fanner (Mr. Hogben), against Balfour M. Irvine, ot Auckland, optician (Mr. Terry), before Mr. Justice Callan in the Supreme Court yesterday. The plaintiff set out that ho entered the employ of defendant on defendant's farm at Papakura as a farm labourer on August 1, 1931. Ho claimed that, on January 7, 1932, defendant requested him to undertake the whole management of the farm, which he agreed to do if defendant paid him a fair and proper wage, additional to his former wage as a farm labourer.

Plaintiff said ho continued to act as manager for 280 weeks, and claimed that a fair and proper wage as farm manager was not less than J3os a week in addition to tho wages of a farm labourer. Plaintiff said that defendant had failed to pay him a fair and proper additional remuneration for his services as farm manager, but had paid him only the wages of a farm labourer, j plus £3O. Plaintiff claimed £390, being £420 wages as farm manager for the 280 weeks, less £3O already paid. Ho also claimed £ls remuneration for caring foi and rearing a foal and later selling it Defendant admitted employing plaintiff as a labourer, but not ns a farm manager. Ho admitted that plaintiff had worked on tho farm from January 7, 1932, to May 27, 1937, but said that ho was paid wages at tho rate agreed on between them, plus bonuses periodically, and an additional £3O at termination of employment. Defendant also claimed that plaintiff's services in regard to tho foal were recompensed by bonuses from time to time. "This case is before tho Court because both plaintiff and defendant are highly nnbusiness-like people," said Mr. Hogben in opening his case. The hearing of plaintiff's case continued until tho adjournment of proceedings yesterday. Witnesses for the defence will be called to-day.
