CONDITION OF DRIVER DOCTOR NOT CERTAIN [from our own* correspondent] HAMILTON, Monday ' Pleas of not guilty were entered bv Russell Vincent Clarke, contractor, aged 28, when he was charged before Mr. S. L. Paterson, S M., in the Police Court to-day with being intoxicated in charge of a motor-car on the Great South Road on April 26 and with negligently driving a car on the same date. The magistrate said he-would require time to consider the case, and judgment was not given to-day. .. Constable C. B. Kimberley, of Hamilton, gave evidence that on April 26 he was called to the scene of a motor collision on the main south road - at Te Rapa. Witness said •he arrested accused, who was in charge of one of the cars, because he appeared to be under the influence of liquot. There was a number of broken beer bottles at the scene and accused had admitted these were his. Evidence that he examined accused about an hour after the accident was given by Dr. A G. Waddell. who stated that he could not be actually certain whether accused was fit to drive a car pt not; In the witness box accused stated that he had had five glasses of beer at Hamilton in the afternoon and had later bought four bottles at Frankton, which he intended to take hom* in his car. "The doctor was not prepared to giro an opinion one way or the other," said Mr. Paterson, "which means that accused had sufficient liquor to impair his judgment "
