BORDERLINE CASE
INTOXICATION CHARGE DRIVER TO PAY £2 FINE , "I will not interfere with your licence in this case," aaid Mr. F. K. Hunt, S.M., in fining Frederick Clifford Arns, motor-truck driver, aged 32, £2 and costs in the Police Court yesterday for being intoxicated in charge of a motor-car on February 24. The magistrate agreed that the case was a borderline one. A caution about the conduct of accused and two friends was delivered by a constable at the recreation ground in Ferguson Street, Freeman's Bay, said Detective-Sergeant McHugh. Shortly afterward, the three men entered the car, and accused moved the vehicle a short distance. His friends in the back seat of the car were handing round a beer bottle. Accused was tlum arrested. Dr. Joseph Thompson stated that when examined accused was under the influence of alcohol to the extent of being unfit to be in charge of a motorcar. He later agreed with a report from Dr. John Dreardon that it was a borderline case. Appearing for accused, Mr. Noble asked that his licence should not be cancelled as it was necessary for bis employment. Stating that he would not interfere with the licence, the magistrate pointed out that accused had not driven his car anv distance.
