MAINTENANCE APPEAL
ADJOURNMENT GRANTED ABSENCE OF COUNSEL Owing to the absenco through injury of counsel for the appellant, Mr. R. A. Singer, an appeal under the Destitute Persons Act was adjourned by Mr. Justice Fair in the Supreme Court yesterday. The appellant was Hallvburton Johnstone, who lodged an appeal against a decision of Mr. W. It. McKcan, S.M., on March 8, granting his wife. Mary Mitchell Johnstone, a separation order and a maintenance order against him for £2 10s a week. The appellant alleged that the decision was wrong in law and in fact and was not supported by the evidence. Ho denied that ho had failed or intended to fail in providing for his wife, or that he had been guilty of cruelty toward her. Mr. Robinson, for the appellant, said that this was a matter which Mr. Singer had been taking prior to his unfortunate accident. The appellant insisted upon Mr Singer taking the matter, and he therefore asked for an adjournment. Mr. Elwarth, for the respondent, offered no objection. His Honor said it was proper to grant an adjournment.
