The charge was a sequel to an accident after a dance at Taradale when a Maori was knocked down and had one leg injured. In evidence it was alleged that defendant said, when requested to take the injured man to hospital, "Let his own drunken friends take him."

The magistrate said defendant's first duty was to the man. The evidence of negligence had been overwhelmingly proved.
