AIR NAVIGATION

COMMONWEALTH'S POWERS INVALIDATION OF ACT Times Cable LONDON, Nov. 15 The Times, In an editorial article, reviews at length the difficulties of the situation arising from the High Court of Australia invalidating the Commonwealth's Air Navigation Act, following upon the marketing case. It expresses the opinion that there is little doubt the electors will grant the Government powers to control aviation but, while the Government is confining the powers sought at the forthcoming referendums to the minimum necessary to carry out its functions, even its modest request regarding marketing is meeting with strong opposition and may not be carried.

Commenting on criticisms of the States and others, the pnper says it is unfortunate that the Federal Government, amid the controversy regarding one amendment, is compelled to seek another, but the authors of the Constitution did not contemplate a world in which aviation, labour conditions and marketing would become matters of international agreement. Consequently, they did not provide against possible difficulties which have added fresh fuel to the controversy regarding the extension of Federal authority.
