J. King), against the Public . Works Department (Mr. H. T. Gillies), in the Supreme ■at Hamilton yesterday. The ground of the claim was that Dibble's farm of 602 acres at Tauhei had been detrimentally affected bv the action of the in constructing the Eastern Outlet, a large drain, through his property. Mr. Justice Johnston presided, "and associated with him Mere the Hon. John Alexander, M.L.C., and Mr. H H Hicks. Claimant said the department's drain was 14 feet wide and seven feet deep and extended for 100 chains through his farm. While he agreed that the drain might be necessary as part of the department's comprehensive scheme to drain the Taupiri swamp, he contended that, as far as he was concerned, the drain; was of no value, the existing internal system of drainage, with its outlet .through the millraco drain, being . < adequate and efficient. Claimant admitted that the depart- * ment's new drain was nearly completed' before he purchased the property last year. The claim, he said, was based ' pn the cost of building four bridges across the <jl:raitt at £25 each, and fencing the dr,ain on both sides, the cost of which would be £2OO. Beforfe the completion of the case it was announced that a settlement had been reached. The terms were not disclosed.
