DAMAGES CLAIM FAILS

MOTOR COLLISION CASE BOTH PARTIES NEGLIGENT [by telegraph—OWN correspondent] OPOTIKI, Wednesday At the Magistrate's Court at Opotiki, before Mr. E. L. S.M., Miss Margaret Shaw, of Opotiki (Mr. Hodgson), sued Frederick Hansen, of Motu (Mr. Beufoy), for £l3 16s 6d damages arising from a collision at the intersection of Church and Bridge Streets, Opotiki, on January 2 last. Plaintiff's case was that she was driving from Ohiwa and at the intersection she met the car driven by plaintiff, who was cutting the corner, and a collision occurred. Defendant said he turned the corner on his correct side and plaintiff swerved to her right, striking him. The magistrate said both sides were negligent, defendant in not being on his correct side, and plaintiff in not keeping a better look-out. Judgment was given for defendant, with costs.
