LICENSEE PROSECUTED DISMISSAL OF CHARGES Two charges of a similar nature under tJie Licensing Act were preferred against Cecilia McGregor, former licensee of the Globe Hotel, Papakura (Mr. Northcroft), in the Police Court before Mr. Wyvern Wilson, S.M., yesterday (it was alleged that defendant on September J9 had in her possession a bottle bearing the label "Dewnr's Whisky," aiud without destroying the label made use of the bottle for bottling liquor for sale. The second charge referred to a. bottle bearing the label "Perfection Whisky." Defendant pleaded not guilty. ; Kenneth Masscy Griffin, Government analyst at Auckland, said he had examined samples of whisky forwarded to him by the senior inspector of the Health Department, Mr. N. F. Furness. As a result of tests, he had come to the conclusion*that the samples were not genuine Perfection or Dewar s whisky. Mr. Northcroft submitted that the section of the Act under which the charge was laid required some act of wrong-doing, which was absent in the present case. There was also no proof that the whisky forwarded . to the analyst, together with the samples taken from the hotel, was true to label. The agent could say no more than that iae believed the whisky he had was of a certain type. Defendant said the bottles had not been interfered with to her knowledge. She had never purchased draught whisky. The magistrate said tho impression he had gathered from the evidence was not that the bottles had been filled again, but that something had bee_n added to the whisky to "emger it up." That aspect was not covered by the charge against defendant. The informations would be dismissed. '
