HOUSE AT KERIKERI
BUILDING COSTS DISPUTE MR. JUSTICE FAIR'S DECISION Judgment was given by Mr. Justice Fa;!r in the Supreme Court on Saturday in the case in which Arthur Edward White, engineer, of Kerikeri (Mr. Leary), claimed from Ernest Park Moir, retired accounting officer, of Kerikeri, (Mr. Goldstine and Mr. O'Dormell). a sum of £291 Is 4d, alleged to' be due for extras , and incidentals on a house which plaintiff had built for defendant at Kerikeri in 1931. The contract price for the hojise and outbuildings was £1823. The defendant counterclaimed for £268 4a 4d for allegedly negligent and incomplete work.
After Mr. Leary had completed his address His Honor said he was prepared to give judgment at once. It was an unfortunate and rather troublesome series of questions that had arisen. These two gentlemen started at the beginning of the, contract on the most friendly terms,' but wheq it came, to, the finalising of a number of comparatively small items they fell out.
The net result of His Honor's findings on the ' detailed items was that plaintiff succeeded to the extent of £lB5 on the claim and defendant "to tho extent of £45 on the counter-claim. Each was allowed costs on the lowest scale, and plaintiff was also allowed couts of four extra days at £6 6s a day. . .
