BENZINE MEASUREMENT CASE

Tho judgment of Mr. J. L. Stout, S.M., in an action brought by J. H. Bodle, service station proprietor, against the Vacuum Oil Company Proprietary, Limited, has been reversed by Mr. Justice Blair in the Supremo Court at Palmerston North. Tho case arose over an alleged over-payment for benzine supplied by tho company, due, according to plaintiff, to the use of measuring rods "wrongly and falsely calibrated."

In reversing the decision of the magistrate, who had found in favour of Bcklle, Mr. Justice Blair gave a lengthy description of the process of measuring the contents of a'petrol tank. He said that there s was no definite proof of erroneous calibration, or measurement, at any particular point of time between .August, 1929, and May, 1932. Concerning the 'magistrate's statement that in his opinion there was no doubt that the method of calibration favoured the oil companies, His Honor said that on the facts before him ho could not arrive at any other than ap opposite conclusion. The company's appesil was- allowed with Costs.
