NEW TRIAL SOUGHT
DAMAGES CLAIM SEQUEL
COMMENT BY HIS HONOUR
An application for judgment for defendant, or, in the alternative, for a new trial, was brought before Mr. Justice Smith in the Supreme Court yesterday. The case, which was originally heard by His Honor last August, was that in which Ronald F. G. Quedley, freezing works employee, claimed £394 damages from Alfred Allen, of Takapuna, on account of a motor collision. The jury that heard the case awarded £75 general and £l3O special damages. Mr. Holmden, on behalf of the defendant, Allen, applied for judgment, or for a new trial, on the ground that the verdict was unreasonable and Against the weight of evidence. This was opposed by Mr. Dickson, representing Quediey. In the course of the argument His Honor remarked that personally ho had not been satisfied with the jury's finding that the plaintiff had not been guilty" of contributory negligence, but the question for him was whether 10 reasonable men could have come to that conclusion.
After hearing argument His Honor reserved his decision.
