VISITOR TO THE FARM VERSION GIVEN OF DISPUTE i Clarence Ivjn Baldick, clerk, of 20 "York Street, Parnell, said he had known Mr. and Mrs. Lakey, and had visited their farm at Christmas, 1932. He was there from December 24 to January 6. Miss Venn was there at the same time. He did some shooting at, rabbits with a pearifle and a shotgun, which he got from the Lakeys. Mr. Meredith: What kind of pearifle was it?—l do not know how you tfould describe it.

Would you know what it was like? — Yes.

Witness said it was very similar to the one shown him, if that was not the actual nne. He helped Mr. Lakey about the place, and had helped him to get his launch off the swamp. Mr. Meredith: On th.it day did you see Lakey talking to Bayly? —No.

You know where the boundary fences are between Lakey's and Bayly's?—Yes. Did you see them talking close to their boundaries on any occasion? — Yes.

Did you go down to where they were? —Yes.

Why?—To help drive heifers into the paddock. What did you hear them say?— That if either one came on the other's property they would come to blows. Argument Between Parties The Magistrate: Do you remember the words of either of them? —Bayly said that if Lakey came on his property he would attempt to attack him. I can't remember the exact words. Mr. Lakey suffered from rupture, and Bayly said that if it were not for that he would not hesitate to attack him. Otherwise fight him? —Yes. Lakey said that if Bayly came on to his property he would fight him. Do you remember any of the words or phrases used by either of them ? —I have no recollection of anything else said. Mr. Meredith: Did you say you were going to drive stock? —Yes, from Lakey's property. They were heifers. There were no bulls in that paddock. Bayly's bull had been driven out of that paddock by Mrs. Lakey while I was away with Lakey. There was no discussion about the bull when I was present, except between Mr, and Mrs. Lakey. It was said that the bull had jumped the fence into the paddock. How long before the bull was put out did this discussion between Bayly and Lakey take place?— Some minutes. Did you see the bull chased out? — No.

Do you know Mr. Stent? —;Yes. _ Did you see him during this visit? — Yes.

Who was with him? —Bayly. They both came to Lakey's on horseback. Whereabouts on Lakey's property were they?— Just outside the house. Bayly came from his own home, which was straight across. Complaint of Damage

How did he get frofn his property to Lakey's?—He rode straight up. I don't know how he got through the fence. Witness said he would be about 15 or 20 yards away when Bayly and Lakey started talking. Witness went over because his action in crossing Bayly's road was commented on by Bayly. Bayly complained of some damage done. Witness remembered Bavly calling on Stent .to witness that he had requested Lakey to remove a certain fence. Lakey refused to remove the fence and Bayly said he would remove it. Mr. Meredith: What happened after that? —Mrs. Lakey came out of the house.

Was anything more said ?—I do not remember anything except that Mrs. Lakey said, " Your bloody, guilty conscience is pricking you." This was said to Bill Bayly. More was said, but I have no recollection of it.
