BREACH OF PROMISE
NURSE AWARDED £IOO DEFENDANT MARRIES ANOTHER A claim by Marjorie Aldcrson, nurse, against Thomas J. Byan, dental surgeon, for £4!J9 damages for breach of promise of marriago, was heard in the County Court in Melbourne recently. The action was undefended. Counsel for plaintiff said that Miss Alderson began keeping company with Ryan jn 1927. They became engaged in July, 1020, and it was arranged between them that they should be married on Christmas eve last year. Ryan visited Miss Alderson regularly until the end of November, when he disappeared as far as she was concerned. Plaintiff consulted a solicitor and a letter was sont to Ryan. In response to the letter Ryan went to see Miss Alderson, admitted that he had treated her badly, told her that he still loved her and that he intended to marry her. It was then arranged that the marriage should take place on May 27 of this year, llyan told her he would sell his practice and that they would go to Sydney to livo. Plaintiff had not seen Ryan since May 11, but she had been informed that he was married to another woman in December last. The Judge said that as there was no denial of Mi<ss Alderson's claim ho would assume that the promise of marriage had been made. Apparently Ryan was already married when ho made his second promise of marriage. Plaintifl would be awarded £IOO damages, with costs to bo taxed.
