SALE OF TROTTING MARE
SHARE OF FIRST STAKE VENDOR'S CLAIM DISPUTED [BY TELEGRAPH —PRESS ASSOCIATION] DUNEDIN. Thursday A case of interest to trotting owners was heard in the Magistrate's Court to-day before Mr. J. R. Bartholomew, S.M. Robert Green, of Oamaru, sought to recover from Mathew Henry Dawson, of Dunedin, the sum of £SO alleged to bo duo out of the first winnings of the trotting mare Elite .Bingen, which plaintiff sold to defendant for £2OO, plus £SO out of the first stake. Defendant adnjitted the horse was subject to a contingency at the time of sale, but denied liability on the ground that the registration of the contingency expired on July 31, 1932, prior t<> Klito Bingen's first win, which was at Wyndham in March, 1933. Plaintiff contended that there was no question of a time limit when the sale was made and claimed that ho was entitled to £SO out of the first stake of the horse's career subsequent to tho sale. § The magistrate reserved decision, remarking that tho point was a new one to him and would take time to consider.
