UNKNOWN TO JUDGE POSSIBLE EFFECT ON SUIT The action of Mr. Justice Street, in Sydney, in making absolute a decree nisi, in a divorce case, without knowing that the petitioner had died in Brisbane, may have interesting legal developments. A message from Sydney stated that the announcement of the death of the petitioner was contained in a telegram handed to the solicitors as they left the Court, following the ordering of the decree absolute. It has been pointed out by officials of the Crown Law Department in Brisbane that if the petitioner's death occurred in Brisbane before the Judge made the decree absolute, the latter action would be null and void, and the respondent would still be the wife of the deceased, entitled to all legal benefits in the subsequent disposal of property, subject to the existence of any will. Legal officers say they cannot recall a similar case occurring in Queensland.
